The employer cannot refuse the leave or its extension. However, long periods of leave penalize the employee in terms of both seniority and pension calculations.
In its current version, article L 225-54 of the French Labor Code stipulates that the duration of parental leave is taken into account for half of the employee’s seniority entitlement.
If passed as it stands, the bill containing various provisions for adaptation to European Union law in the fields of the economy, health, labor, transport and agriculture (DADUE) could change things a little. “It provides for the duration of leave to be taken into account in full for those on part-time leave”, warns Alexandra Stocki, lawyer and partner at Proskauer.
